These Terms of Service ("Terms") govern your use of the PlanckStudio website, digital applications, and contracted design and software development services. By engaging with our studio, you agree to these Terms in full.
1. Acceptance of Terms
By accessing our platforms or executing a Statement of Work (SOW) with PlanckStudio, you certify that you have legal capacity to bind yourself or the legal entity you represent to these Terms.
2. Services & Scope
PlanckStudio delivers software engineering, application development (Android & web), UI/UX design, and creative consulting. Specific deliverables, delivery schedules, revision cycles, and pricing are codified within individual project proposals or SOWs signed by both parties.
3. Intellectual Property Rights
Client Deliverables: Upon full and final settlement of all agreed project fees, all bespoke code, custom design assets, and documentation created specifically for the client are assigned unconditionally to the client.
Studio In-House Products: All rights, title, and interest in proprietary PlanckStudio products (including our proprietary Android tools, design libraries, and software frameworks) remain the sole property of PlanckStudio.
4. Fees & Payment Milestones
Unless otherwise stated in a project agreement:
- Projects require an initial commencement deposit prior to scheduling kickoff.
- Subsequent milestones are invoiced upon approval of pre-defined deliverables.
- Invoices are due within 14 calendar days of presentation.
5. Confidentiality & Non-Disclosure
Both parties agree to hold all non-public commercial, technical, and proprietary information disclosed during engagements in strict confidence, exercising reasonable care to prevent unauthorized disclosure.
6. Limitation of Liability
To the maximum extent permitted by applicable law, PlanckStudio shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits or revenues, arising out of software usage or project delays.
7. Governing Law
These Terms shall be interpreted and governed in accordance with the laws of India, without regard to conflict of law principles.
